Data protection information for the background check by the Bundeskriminalamt at the ILA 2024 on June 5, 2024

 

The Federal Criminal Police Office (Bundeskriminalamt - BKA) is conducting a background check on the occasion of the ILA 2024, which will take place from 5 to 9 June 2024 on the area of the Berlin Expo Center Airport in 12529 Schönefeld, Selchow district (hereinafter "BECA area"), in accordance with § 6 para. 1 sentence 1 no. 1 of the Act on the Federal Criminal Police Office and the Cooperation of the Federal and State Governments in Criminal Police Matters (Gesetz über das Bundeskriminalamt und die Zusammenarbeit des Bundes und der Länder in kriminalpolizeilichen Angelegenheiten - BKAG). For this purpose, the BKA has requested Messe Berlin GmbH and its group companies (hereinafter collectively referred to as "Messe Berlin") on the basis of Section 9 para. 2 sentence 1 BKAG to provide information on those persons who will be present or working on 5 June 2024 as employees or executive bodies of Messe Berlin, as employees and executive bodies of exhibitors, as journalists, as employees of service providers or in other functions for the ILA 2024 in Halls 2 to 4 on the BECA area. With this data protection notice, we are informing you about the processing of your personal data by Messe Berlin in connection with the aforementioned background check by the BKA. 

1.    Data controller and data protection officer
1.1    Messe Berlin

Data controller at Messe Berlin for data processing within the meaning of the General Data Protection Regulation (GDPR) in connection with the background check are:
 

as joint controllers on the basis of an agreement on joint controllership pursuant to Art. 26 GDPR, whereby each company is responsible for processing the data of its employees and executive bodies and for processing the data of employees of the service providers engaged by them. Messe Berlin GmbH is also responsible for processing the data of employees and executive bodies and for collecting and transferring all data to the BKA. 

The data protection officer of Messe Berlin is the joint data protection officer, who can be contacted at the above-mentioned contact details of Messe Berlin GmbH and at the following e-mail address: datenschutz@messe-berlin.de

1.2    Federal Criminal Police Office (BKA)
The controller for the processing of your personal data by the Federal Criminal Police Office is the Federal Criminal Police Office in 65173 Wiesbaden (BKA). The BKA acts as an individual controller. For further information on data processing by the BKA, please refer to the BKA's data protection information (available at www.bka.de/EN/Service/DataPrivacyStatement/dataprivacystatement_node.html). 

2.    Categories of data subjects, categories of personal data, source of the data and type of processing
The companies of Messe Berlin named in Section 1.1 process the following categories of personal data for those persons for whom data is provided in the comparison list as employees or organs of Messe Berlin, as employees and organs of exhibitors, as journalists, as employees of service providers or in other functions, insofar as this data is provided in the comparison list:  

  • Surname and first name, 
  • Date and place of birth
  • Service provider company  
  • Function and location at the ILA 2024 on 5 June 5 20224

for service providers of the security / public order service additionally: 

  • Guard ID

The data will be collected by the companies of Messe Berlin GmbH named in Section 1.1 from their employees and executive bodies, the contact persons at the exhibitors and service providers and from journalists using the BKA's comparison list. The data in the completed comparison lists will be transmitted to the BKA by Messe Berlin GmbH. 

On 5 June 2024, the BKA will check the access authorization of the persons concerned at the entrances to Halls 2 to 4 on the BECA area and, if necessary, at other locations on the BECA area by means of a data comparison by visual inspection on the basis of the comparison list and upon presentation of a valid identity document (with photograph) by the persons concerned. Those persons whose reliability has been confirmed on the basis of the data previously transferred to the BKA by Messe Berlin GmbH using the comparison list will be granted access to the restricted event area. For all other persons covered by the background check, access may be temporarily denied on 5 June 2024 or the BKA may conduct a corresponding background check on site.  

You are not obliged to cooperate in the processing of your personal data, but if you do not cooperate, you must expect that you will be temporarily denied access to Halls 2 to 4 on the BECA site on 5 June 2024 or that a background check will be conducted on site.

3.    Processing purposes and legal bases
The purpose of the data collection and transmission from Messe Berlin to the BKA and the data processing by the BKA is the background check in accordance with § 6 para. 1 sentence 1 no. 1 BKAG on those persons who will be present or working in Halls 2 to 4 on the BECA area on 5 June 2024 as part of the ILA 2024. 

The legal basis for the transfer of data from Messe Berlin to the BKA is the legal obligation of Messe Berlin pursuant to Art. 6 para. 1 sentence 1 letter c) GDPR in conjunction with § 9 para. 2 sentence 1 BKAG.

The BKA processes the personal data transferred on the basis of § 9 para. 2 sentence 1 BKAG. 

4.    Categories of recipients of the data
To carry out certain processing activities in connection with the event (in particular the use, hosting and support of software and other IT services), Messe Berlin uses external service providers as processors on the basis of a data processing agreement in accordance with Art. 28 GDPR. If the processors are based in a country outside the European Union / the European Economic Area, the transfer is secured by an adequacy decision of the European Commission pursuant to Section 45 GDPR or standard contractual clauses have been concluded with the processors pursuant to Art. 46 para. 2 letter c) GDPR. 5.    Storage duration
Stored personal data will be deleted as soon as it is no longer required for the purpose for which it was processed. The lists compiled by Messe Berlin will be deleted by Messe Berlin on 10 June 2024 at the latest. 

6.    Data protection rights
To exercise the following rights, you can contact the data controller at any time using the contact details provided in section 1. 
Data subject rights pursuant to Art. 12-21 GDPR: The right of access to personal data, the right to rectification, erasure and data portability and the right to restriction of processing. 
If you believe that the processing of your personal data violates data protection law, you have the right to lodge a complaint with a supervisory authority of your choice (Art. 77 GDPR).
